Megan Balakumar joined Health Legal in 2003 and has provided advice to the health clients on a range of commercial, litigation and medico-legal issues. Megan has advised upon and negotiated numerous leases for a broad range of clients, including public health services, public hospitals and community health centres. Her leasing experience extends to retail, non-retail residential leases and Crown land leases. Megan has also drafted and advised on various forms of service Agreements relating to a broad range of issues, including retail services agreements, pharmacy contracts, medical equipment sale and maintenance agreements, clinical placement agreements, cleaning and linen contracts as well as information technology service agreements, software licences and patient transport agreements. Megan also has experience in drafting and negotiating visiting medical officer contracts and advising Health Services on a variety of employment related issues. She has also advised on various patient related medico-legal issues involving questions concerning patient consent and duties of care. |
Megan has drafted a variety of policies for Health Services, including polices on incident investigation, consent to treatment, limitation of medical treatment, confidentiality, freedom of information, privacy, conflict of interest and documentation guidelines. Megan has assisted with Coronial Inquests, investigations of the Medical Practitioners Board of Victoria, and has represented a chiropractor in a hearing before the Medicare Participation Review Committee in relation to allegations that the chiropractor engaged in a prohibited diagnostic practice under the Health Insurance Act 1973 of Victoria, and has represented a chiropractor in a hearing before the Medicare Participation Review Committee in relation to allegations that the chiropractor engaged in a prohibited diagnostic practice under the Health Insurance Act 1973. Megan is also closely involved in managing the development and updating the legislative compliance products that Health Legal offers to health sector clients. She has also conducted audits of health services' legislative compliance. In addition, Megan has undertaken a number of secondments at public health services, where her role has ranged from assisting with commercial projects to acting as Legal Counsel. |
